Welcome to Dog Whistle & Clicker Pro . By downloading, installing, or using our mobile application, you agree to be bound by these Terms and Conditions ("Terms"). If you do not agree to these Terms, please do not use the App.

These Terms constitute a legally binding agreement between you and Dog Whistle & Clicker Pro ("we," "our," or "us") regarding your use of our mobile application (the "App").

2. Description of Service

Dog Whistle & Clicker Pro is a mobile application that allows users to train their dogs to respond to a whistle and clicker.

3. Disclaimer of Warranties

THE APP IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED. TO THE FULLEST EXTENT PERMISSIBLE UNDER APPLICABLE LAW, WE DISCLAIM ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

We do not warrant that:

• The App will meet your specific requirements
• The App will be uninterrupted, timely, secure, or error-free
• The results obtained from using the App will be accurate or reliable
• Any errors in the App will be corrected

4. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL WE BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING WITHOUT LIMITATION, LOSS OF PROFITS, DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES, RESULTING FROM:

• Your access to or use of or inability to access or use the App
• Any conduct or content of any third party on the App
• Any content obtained from the App
• Unauthorized access, use, or alteration of your transmissions or content

Our total liability to you for any damages shall not exceed the amount paid by you, if any, for accessing or using the App during the six (6) months immediately preceding the date of the claim.

5. Indemnification

You agree to defend, indemnify, and hold harmless our company, its officers, directors, employees, and agents, from and against any claims, liabilities, damages, losses, and expenses, including, without limitation, reasonable legal and accounting fees, arising out of or in any way connected with your access to or use of the App or your violation of these Terms.

6. Modifications to the App and Terms

We reserve the right to modify or discontinue, temporarily or permanently, the App or any features or portions thereof without prior notice. We also reserve the right to update these Terms at any time. We will notify you of any material changes by posting the new Terms on the App or by sending you a notification. Your continued use of the App after such modifications will constitute your acknowledgment of the modified Terms and agreement to abide and be bound by them.

7. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the United Kingdom, without regard to its conflict of law provisions. Any dispute arising from or relating to these Terms or your use of the App shall be subject to the exclusive jurisdiction of the courts of the United Kingdom.

8. Severability

If any provision of these Terms is held to be unenforceable or invalid, such provision will be changed and interpreted to accomplish the objectives of such provision to the greatest extent possible under applicable law, and the remaining provisions will continue in full force and effect.
